NR-1 and psychosocial risks: what the company needs to have on hand

What changed in risk management, what counts as a psychosocial factor and how to listen to the team without exposing anyone.

This article is about Brazilian labor law (CLT, NR-1, Law 14.457 and related rules). It does not apply to other countries. The source texts are in Portuguese; this is a translation.

Since May 26, 2026, psychosocial risk factors are part of occupational risk management under NR-1. In practice, the company must identify, assess and address these risks in its Risk Management Program (PGR), the same way it does with noise or chemicals.

What counts as a psychosocial factor

  • Targets and pace that do not fit the time available.
  • Lack of clarity about each person's role.
  • Little support from leadership.
  • Harassment and conflicts left unaddressed.
  • Working hours that prevent rest.

That last point has a new reference: under Constitutional Amendment 141/2026, the weekly limit drops to 42 hours in December 2026 and to 40 hours in December 2027, and paid weekly rest goes up to 2 days on the first of those dates. It is worth reviewing schedules together with the inventory.

What the company needs to have on hand

  • A risk inventory with these factors, by area or role.
  • An action plan with an owner and a deadline.
  • Records showing that the assessment was done and repeated.

What about fines?

In June 2026, Brazil's Supreme Court (STF) suspended the application of sanctions for these items for 90 days within ADPF 1.316, without suspending the standard itself, and the full court upheld the decision in August. In September, the reporting justice extended the suspension for another 90 days, which takes it to December 2026, while conciliation continues at the court. This is the kind of topic that changes: check the current situation with your lawyer or the company's SESMT (occupational safety and medicine service). The duty to manage the risk remains.

How to listen without exposing anyone

A survey only works if people trust they will not be identified. That is why IP's psychosocial pulse is anonymous, truncates the date to the month and only shows results for groups with 5 or more answers.
